The BC Supreme Court sentencing trial for a Wet’suwet’en Hereditary Chief and land defender, Chief Dtsa’hyl (Adam Gagnon) took place on Tuesday July 2nd and Wednesday July 3rd in Smithers BC Courthouse.
Chief Dtsa’hyl was charged with criminal contempt for defying a court injunction on Coastal Gaslink’s job site access on Wet’suwet’en land in October 2021.
Justice Michael Tammen decided on a sentence of a 60 days to be served at home due to many factors, including that this is his first offence, and also that the principles of Gladue, an amendment that was included in the Criminal Code of Canada in 1996 that implores courts to seek incarceration as the last resort for Indigenous offenders.
